1. Acceptance of Terms

By accessing or using summry ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and summry.

2. Description of Service

summry is an AI-powered personalized news digest service. Users define topics they want to track, and the service automatically searches the web, curates relevant content, and delivers AI-generated digests to the user's inbox on their chosen schedule. The Service includes:

Digest creation and management tools
AI-powered content search and generation based on user-defined topics
Automated email delivery to your inbox
Business tier: optional digest sharing with up to 20 recipients, with double opt-in confirmation

3. Account Registration

To use the Service, you must:

Be at least 16 years of age
Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree NOT to use the Service to:

Send unsolicited emails (spam) or abuse the digest delivery system
Distribute malware, phishing attempts, or malicious content
Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Harass, abuse, or harm other users or third parties
Distribute illegal, defamatory, or obscene content
Attempt to circumvent security measures or rate limits
Use automated systems to abuse the Service
Impersonate any person or entity
Collect personal data of others without authorization

Violation of this policy may result in immediate account termination without refund.

5. Digest Delivery

Digests created through the Service are delivered to your own registered email address. You can manage your digest preferences and unsubscribe from individual digests at any time through your account settings or via the unsubscribe link in any email.

Recipient Consent Requirements (Business tier): This section applies to Business tier users who send digests to additional recipients. All recipients must provide explicit consent via double opt-in before receiving digests. You are responsible for obtaining and maintaining valid consent from all recipients.

6. Subscription and Payment

6.1 Plans and Pricing

summry offers free and paid subscription plans. Current pricing is available on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

6.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely through Lemon Squeezy.

6.3 Refunds

Refunds may be requested within 14 days of initial purchase for annual plans. Monthly subscriptions are non-refundable. Contact support for refund requests.

6.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds for unused time.

6.5 Usage Limits

Each subscription plan includes a limit on the number of topics you can track simultaneously:

Free plan: 3 topics
Starter plan: 10 topics
Pro plan: 30 topics
Business plan: 100 topics, plus the ability to send digests to up to 20 recipients

Topic limits are fixed per plan — they do not reset monthly. Upgrading your plan immediately increases your topic limit.

7. AI-Generated Content

7.1 Nature of AI Content

Digest content is generated by artificial intelligence based on the topics you configure. AI-generated content may contain inaccuracies, errors, or outdated information. You acknowledge that AI technology is imperfect and evolving.

7.2 Review Responsibility

You have the option to review and edit content before sending (via the preview feature). If you enable automatic sending, you accept responsibility for AI-generated content delivered to your inbox.

7.3 No Guarantees

We do not guarantee that AI-generated content will be accurate, complete, current, suitable for any particular purpose, or free from errors or harmful content.

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, and technology, is owned by summry and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

8.2 Your Content

You retain ownership of the topics and configurations you provide. By using the Service, you grant us a license to process this content to provide the Service.

8.3 Generated Content

AI-generated digest content may be used by you for your digests. We do not claim ownership of the specific content generated for your digests.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid us in the past 12 months
We are not responsible for any loss of data, business interruption, or reputational harm

10. Indemnification

You agree to indemnify, defend, and hold harmless summry and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Content you distribute through the Service
Your violation of any third-party rights
Any claims arising from your use of the digest delivery features

11. Service Modifications and Availability

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Update features, pricing, or terms with reasonable notice
Perform maintenance that may temporarily affect availability
Limit access from certain regions or users

We strive for high availability but do not guarantee uninterrupted service.

12. Termination

12.1 By You

You may terminate your account at any time through your account settings. Upon termination, your data will be deleted per our Privacy Policy.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct we deem harmful to the Service or other users.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive will survive termination.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, depending on your location and applicable law.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. For EU users, mandatory consumer protection laws of your country of residence apply.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through a notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and summry regarding the Service and supersede any prior agreements.
